Residential Real Estate

Whether you are buying a new house or condominium, the process can be both exciting and stressful.  We have assisted buyers and sellers of residential real estate for over twenty years.  From reviewing the contracts, to searching the title records, to closing your loan, our office will make the process easy for you.  We have streamlined the process by utilizing electronic resources to keep our clients informed, and at all times, we are sensitive to our clients’ needs and concerns.

We recommend that buyers of real property have a survey done before closing, so they will know exactly what they are buying.  A survey will also show any encroachments, easements, or conditions that could affect the use of the property. In addition to a survey, we recommend that buyers obtain an owner’s title insurance policy at closing.  Such a policy will protect the buyer from matters not shown by the public records, forgery, incompetency or incapacity of the parties, fraudulent impersonation, and unknown errors in the public records.  An owner’s title policy provides peace of mind.  You can read more about title insurance by going to the website of one of the title insurance companies which our office issues policies.

 

Commercial Real Estate

Our office can assist with the purchase and sale of ongoing businesses, vacant land tracts, motels, restaurants, and other commercial properties.  We are happy to review and negotiate leases for clients.  Whoever writes the lease often includes terms that are favorable to one side.  We help clients know what their obligations are under the lease. Wills and Probate

A will is a legal document that allows you to control how and to whom certain assets owned by you pass at your death.  Without a will, the law in your state of residence determines who your heirs are.  South Carolina is not a marital rights state, so without a will, the surviving spouse is not necessarily the sole heir.  Our office can prepare a will, durable power of attorney, healthcare power of attorney and living will, so you are in control of your assets and decision-making, not the state law.

Probate is the administration of a person’s estate that is overseen by the Probate Court.  Not all of your assets go through probate.  With proper planning, when the first spouse dies the probate may only consist of filing the death certificate and the will. Our job is to make the probate process easy for your heirs.  Typically we will open the estate within thirty days from date of death and it will stay open for at least one year from date of death.
